I had Pvp and the enemy run from sistem when he almost die.
ANd he is back in 2hours..i think thats role brake or isnt?

Rule-wise, yes.
Fair play? Not so much.

You see him dock, in other words you see <name here> has requested to dock, or you kill him and you see a blue message with his name on the wrong end. If he manages to get far enough from you, outside of radar range and dock without you seing the <name here> has requested to dock message it is perfectly legal for him to repair and come back to haunt you immediatelly

I noticed it a week or so ago. Chuckled, moved on. Especially when I saw the goddamn eagle in the sig. It needs antennas.
