Like i SAID in the first reply...
its perfectly lawful for a BH to kill a usually lawful ship if they're somewhere its illegal for them to be
(Kusarian in Bretonia, Bretonian in Kusari, Rheinland/Liberty comabt ships to be in the other's territory)
And traders can attack others of a hostile faction, but their main priority should be getting their cargo safely to its destination
Its quite simple really
