To be honest, mass murder usually comes hand-in-hand with mental collapse. Maybe he's feeling guilt over the 3,000 plus innocents he incinerated? If he's feeling any guilt at all (and given the attitude of the upper management and spokespeople as a benchmark, I highly doubt that) I'd say it was more due to the innocent blood he's drowning in. It probably would have been kinder if he had died. It certainly would have been more just if he had died instead of the passengers.

Who knows? This destabilised and fragile 'guilt' ridden 'survivor' probably had a pre-existing condition. That would certainly explain the flippant manner in which he culled his charges, then idly chatted to "Paco Pistols" about the same. Either way, I look on with anticipation at what the barbarian has to say for himself.

Dear citizens of Liberty,

I'm sorry to inform you that investigations on this matter have to be canceled. It's not possible to get an official testimony from the [IND]Invisible.Hand's commanding officer. Mr Riche - the spokesman - offered us help during this investigations but it seems to be impossible to get in contact with the captain.
I've ordered my team to keep an closer eye on [IND]-vessels within Liberty space and maybe we will draw consequences after this incident.
Also I'd like to say that we feel very sorry for the innocent victims of this incident.
If there are any new evidences regarding the situation I would like every citizen from Liberty and from other houses to transfer those to us.

As promised we are delivering the Captain of the [IND]Invisible.Hand to your custody, however I must include a letter of explanation from the psychiatrists that have been caring for him on Cortez in the wake of this unfortunate situation with the murderer Paco.Pistols.


Dear officers of the Court,

I am Doctor Jeff Jennings of the Cortez Psychiatric Hospital, I have had the duty of examining Captain Larsons in the wake of the traumatic event that Paco.Pistols subjected him to with the murder of the entirety of his crew, his passengers, and the destruction of his ship. I also supervised his deteriorating psychological condition as a result of extreme survivor guilt where he relives the event in question, and blames himself for the massacre.

He fulfills All the Criterion for Post Traumatic Stress Disorder:
Quote:Criterion A

A person must have experienced a traumatic event where both of the following occurred:

* The person experienced, witnessed, or was confronted with an event where there was the threat of or actual death or serious injury. The event may also have involved a threat to the person's physical well-being or the physical well-being of another person.
* The person responded to the event with strong feelings of fear, helplessness, or horror.

Criterion B

The person experiences at least one of the following re-experiencing symptoms of PTSD:

* Frequently having upsetting thoughts or memories about a traumatic event.
* Having recurrent nightmares.
* Acting or feeling as though the traumatic event were happening again, sometimes called a "flashback."
* Having very strong feelings of distress when reminded of the traumatic event.
* Being physically responsive, such as experiencing a surge in your heart rate or sweating, to reminders of the traumatic event.

Criterion C

The person experiences at least three of the following avoidance symptoms of PTSD:

* Making an effort to avoid thoughts, feelings, or conversations about the traumatic event.
* Making an effort to avoid places or people that remind you of the traumatic event.
* Having a difficult time remembering important parts of the traumatic event.
* A loss of interest in important, once positive, activities.
* Feeling distant from others.
* Experiencing difficulties having positive feelings, such as happiness or love.
* Feeling as though your life may be cut short.

Criterion D

The person experiences at least two of the following hyperarousal symptoms of PTSD:

* Having a difficult time falling or staying asleep.
* Feeling more irritable or having outbursts of anger.
* Having difficulty concentrating.
* Feeling constantly "on guard" or like danger is lurking around every corner.
* Being "jumpy" or easily startled.

Criterion E

The symptoms described above must have lasted for more than a month. If the symptoms have lasted for less than a month, you may have another anxiety disorder called Acute Stress Disorder.

Criterion F

The symptoms described above have a great negative impact on your life, interfering with work or relationships.

It is my professional opinion that Captain Larsons is unfit to answer any questions, participate in any interrogation, or stand trial.

As you can see for yourselves, Captain Larsons is not of sound mind. It is there for my intent to file a motion to dismiss proceedings on the ground that the defendant is unfit to stand trial, for he cannot even answer the most basic of questions in his own defense. Nor offer any reasonable explanation of the events that occoured.

The idea that a criminal defendant should, in a just social system, be able to mentally participate in their trial as well as be physically present dates back to the roots of common law. '€˜Un-fitness to Stand Trial'€™ therefore depends upon the presence of a mental disorder at the time of the trial. It is perfectly possible for a mental disorder to not affect Fitness to Stand Trial but to affect criminal responsibility as the latter would be relevant only at the time that the criminal offense was committed. Similarly, an individual'€™s eligibility for involuntary hospitalization depends on different criteria again.

To be found Unfit to Stand Trial, the individual must, on account of mental disorder, be unable to conduct their defense at any stage of the proceedings before a verdict is rendered or to instruct counsel to do so. In particular, the unfit individual will be unable to understand the nature or object of the proceedings, the possible consequences of the proceedings or communicate effectively with counsel.

The court finds the defendant Larsons unfit due to an inability to participate in the defense of charges against him OR Paco.Pistols because of a mental disorder or illness. The court will examine whether the Captain understands the nature of the trial (who are the people involved, what is the process), whether he understands the possible consequences (what could happen at the end of the trial) and whether he can communicate effectively with his lawyer, or the LSF Agents charged with the investigation.

Captain Larsons is remanded into LPI custody for the duration of the assessment, and a hearing will be held in the near future to reassess this status after the LSF and LPI doctors have had a full and complete chance to examine Captain Larsons.

Be it so noted that information that is shared with the health care professionals will be shared with the court, particularly any information that will help with the fitness assessment.

Director Moesby, I trust that you are more than capable of supervising this assessment period. If it is found that, at a later point, Captain Larsons regains his mental Faculties, then trial will proceed.

So let me get this straight: The IND refuses to talk to the LSF, so the LSF suspend the investigation, as opposed to arresting those in question for the obstruction of justice. The IND then hires a private medical official from a system outside of Libertonian core space, on a planet renown for its lacklustre stance on medical legality to declare their captain conveniently insane.

Post Traumatic Stress Disorder is not a full psychotic breakdown, and would not - should not - exclude aforementioned murderer from participating in his own investigation and court trial. PTSD will not have suddenly caused him to lose any semblance of understanding in regards to what a 'court' is, who a 'judge', 'jury' and 'attorney' is and why he is being tried.

There is a reason that only 1% of defences attempt the insanity defence, and a mere fraction of that 1% work. In this case, I'm shocked you're even considering it. The fact that the court itself declared the Mr Larsons insane without even verifying the claim with a court sanctified psychiatrist stinks of professional incompetance to me. Either way, if this does stand, I hope Mr Larson is looking forward to his near-indefinite stay in a State Institute for the Insane.

Again, I am not surprised Mr Larson is suffering from extreme survivor guilt, given that is was his actions, and his alone that rendered him the only survivor. Let us hope that the judicial system can at least partially redeem itself in this case.

Oh, and Mr Riche, if that is a picture of your client, I would suggest suing
your 'doctors' for clinical incompetence and malpractice.

I suggest, Mister Howard, that you again read the verdict passed by this court. I have ordered Captain Larsons mental soundness to be assessed by the LPI and the LSF.

I have also ordered the Captain of the Paco.Pistols to turn himself in to answer the same questions as Captain Larsons so that Secretary Moesby can get to the bottom of this.

At least Captain Larsons is in custody now. Now then if you have a deposition to make, then I suggest you report to the nearest LSF facility and answer the questions in person. Otherwise, the court will not hear your testimony.

PTSD can lead to a dissociative state that precludes the ability of the patient to actually function inside of normal confines. The Survivor guilt as well causes the patient to believe that he is solely responsible for the event at hand, and blames himself in a self-destructive fashion.

There is a clear condition in which there is loss of the usual integration of personal identity and memories, sensory and motor functions as a result of this illness.

Self-Blame, your honour, due to mental illness, can cause my client to declare a guilty plea to a crime he didn't commit just to ease the mental suffering. As you can clearly see, he barely understands where he is, there is no way to corroborate testimony, and anything that is said by my defendant at this stage must be weighed against his mental soundness to actually deliver accurate testimony.

We, of course, submit to the second assessment commissioned by the Court.
