Should I bother taking note of people using Colonial equipment (IE independents) or has their stuff become open as of late? I have seen 3-4 independent Colonials in the past couple days and just want to know what is up.

Last time I checked it was still tied to the IMG rep somehow, like a guard rep almost.... but I cannot confirm this.

Yes...a player faction without players (?), but still closed... And CR is not a Phantoms...It is quite a potential micro-house to be open up for indies, surely with some changes in ID, if such would be required.

As for now you can't use the ID, even if you have full rep.

Their tech is actually easy to obtain; rep is not a problem if you just want the ships. I had some weird Order rep, and managed to land.
And there was no clear answer regarding the usage of their tech.
I'd say, personal discretion is the best way.

You can't use their ID. Everything else is okay though, considering you'll suffer of the nerf.
edit : side note, IMG ID and IFF is the best way to use CR stuff.

Make proposal for a new official faction, in the meanwhile fly with anther ID and when you get official ask to get the CR ID back.
