The Corsairs, Outcasts, and Hessians can do it because they're the first, second, and third largest unlawful groups in Sirius respectively in terms of sheer population size (which translates indirectly to resource income and therefore; logistics and manpower capacity, two of many things needed to design, build, supply and field capital ships)
I understand Disco likes to play fast and loose with the concepts of realistic logistics emulation and logic, but a group like the Xenos or Gaians having access to their own battleships dosen't make a terrible amount of sense, especially given the lack of a usable shipyard. In certain fringe cases, some smaller groups might be able to but that can be accomplished via a player SRP through sufficient RP justification on the part of those factions.

I think it wouldn't make sense to allow Outcasts or Corsairs so far from their immediate hunting grounds but we have what we have even it doesn't make much sense.
