Piracy is malicious gameplay. You're setting out to make someone else miserable. You're the kid on the playground beating up other kids for their lunch money.
If you, as a pirate, fail to actually kill your target before they reach a base, you have failed. Utterly. Completely. You are a terrible pirate. Asking for the trader to be punished in any way due to your incompetence is absurd.
The trader wins a piracy encounter by docking. They should not be punished for that. If they come back in their Navy cattlebruiser within its ZOI and keep it in-RP (e.g., "There were reports of pirate activity in this area--looks like we found it"), I see nothing wrong with that.
If they come back in a Zoner cap and say "U SHOT MY TRADER NOW DAI"-- that's already against (multiple) other rules and 5.6 doesn't need to be updated to reflect that.
People abusing the system (aka, lolwuts) will be caught under other rules anyway.

I don't know if you read the forums but if you did you would knew that half of the playerbase get miserable over something game related. I suggest reading faction feedback threads for more insight.

Transports that dock with a enemy in tow aren't dead per PvP rules, thus they are free to swap ships and go pew pew their aggressor as far as I can tell by reading the rules as they are now. Doesn't mean I think its right, nor would I suggest doing it. Admins still have their wildcard that allows them to use their hammers and swords on you should they want to do so.

While you may not see anything wrong with them coming back in their Navy Battle cruiser I do, it's a form of metagameing and that's just lame lame lame.
Also traders are Rich it would be much more in RP for them to hire a bounty hunter to hunt the pirate down and kill him.
