So attacking and destroying with no notice is OK?

i was attacked and destroyed just after un-docking with no notice. the other player stated that it is acceptable to open fire and destroy a ship with no notice based solely on the other ships iff (vs. his) and our location in Sirius at that moment. is this correct? i keep seeing the server messages that all interactions require at least a communication, "yelling halt" is not enough. what about blowing me into space after i undocked with no notice at all? he told me in sys chat he isn't required to give notice as i was within 2k of him.. screenshots of chat available upon request.

to be honest i didn't know he was there until i was dead and saw i was killed by a non-npc. i wouldn't think so as i was in kepler.
