If you're jittering because of your framerate (lag/loss are another issue) then you're cheating. My guess is that the admins picked 160fps as its a safe bet that if you are above 160, you WILL jitter. That doesn't mean that if you find a way (accidentally or on purpose) to jitter below 160fps that you won't be smacked for it.
ok what about people that play on desktops with a half decent setup, but to the laptop user they show as jittering, isnt that down to slower laptops, that are not made for gaming and can not "render" the scene as fast as desktops if his frame rate goes over 75, is that the fault of desktop users?

Not to sound overly harsh, but there are people out there on the server who simply don't take losing very well and prefer accusing others of some form of cheating over simply taking the loss (and learning from it).
Or they're interpreting quick strafing and/or quick switches from thrusting to reversing and vice versa as some form of 'stutter', while it's really just quick movement.
It is of course possible that your framerate limiting software is doing a piss-poor job and is either not actually capping your framerate well, or you're switching between 180 and sub-180 rapidly (averaging out at 120 in the 'long term'), causing brief jitter.
Then again, jitter is pretty damn recognizable and I've never really seen the "lite jitter" that some conn-goers claim others "have". Would love to see a recording sometime.
I've fought you a fair bit, and have not seen you jitter. Unless you very recently adjusted your framerate cap and I have not fought you since, the people accusing you of jitter are making it up and/or mistaking server lag for jitter.

I think jitter is a netcode issue. The performance of the "observer's" machine should not be relevant. I personally used to play on a fairly mediocre system quite frequently, experiencing severe framerate drops, but it didn't cause me to see people jitter.
