On behalf of my client Toji Shibaya, I am requesting his immediate release from Fuchu Prison until his trial has commenced on the basis that the prosecution has no grounds on which to detain him. I further move that unless the prosecution (The Kusari Government) has any solid evidence against my client on the accusations that was brought upon him, that all charges against him is to be dropped.
My client was operating within the full extent of Kusari Law. He was hauling no contraband, operating a legal trade vessel, and fully cooperated with the naval forces in the area.
Furthermore, my client has all the necessary paperwork in order.

To hold him against his will on the grounds of false allegations and absolutely no evidence is a breach in his civil rights.
The arrest of my client was upon a error in the naval officers scanners, and led to his arrest without a single shred of evidence against him. My client and I find the accusations brought against him to be borderline offensive and pulled out of thin air. We await the courts word.

Shibaya-san will remain in police custody on Fuchu until we can obtain a clearer picture of the origins of his ship, his carreer history, and his business in Kusari space on the day of his apprehension.
[color=#FFCC00]--- His birth certificate checks out. Identity confirmed as Toji Shibaya of the Misaki District, Planet Honshu. Misaki General Hospital and the Honshu Census Bureau can validate this with matching copies in their registers.
---Location and date of ship purchase is in question. Takeda & Co. can neither confirm nor deny the sale of a "Borderworlds Transport" vessel on 23 Oct. 809. Preliminary surveys of the vessel in question reveal extensive wear and tear on outer components; significantly more than is normal for any such ship operating in Kusari and/or GMG space in the area of a decade. Several internal components which were designed to last for at least thirty years have been replaced or, in some cases, removed entirely. At least two components (transponder signal and sensor array internal hardware) confirmed to be not standard factory-made equipment, nor manufactured in Kusari space at all.
---Ship registration number FES-98762-DP confirmed for Borderworlds Transport class vessel "Izenagi", registered 24 Oct. 809. This registration was used to view a log of all known lane and gate activity of the FES-98762-DP "Izenagi" in the past ten years in Kusari. Entries are sporadic, few and far between; do not match up with normal routes and schedules of Samura or GMG vessels as implied by exhibits 6.0 and 7.0. Heavy activity along Kyushu lanes Kyu-001 (New Tokyo gate to planet) and Kyu-002 (Planet to Tsushima), little activity along lane Kyu-003 (Tsushima to Tau-29 gate). Recognizable pattern of many Maltese smugglers.
---All licenses confirmed with New Tokyo Institute of Aerospace Flight, State Police Department of Exoatmospheric Flight, and Hayashi Universal Commodity Contractors. Legitimate.
---Samura job contract (5 Dec. 809 - 3 Aug 810) is confirmed. Shibaya-san is on record as an independent contractor who specialized in the transport of quantum multiplexors for several months before resigning on peaceful terms.
---Gas Miners Guild job contract (27 Aug. 810 - ongoing) is unconfirmed. GMG representatives deny knowledge of a Toji Shibaya. There is no other record of the individual in question working for the GMG, past or present.
Because of the doubt that the KSP currently holds for the legitimacy of your Exhibits 3.0, 4.0, and 7.0, your request for the immediate release of Shibaya-san is denied. As more information comes to light, we will contact you again with our final decision regarding Shibaya-san's alleged criminal status.
Me and my client would like the scheduled court date. So that we may clear his name and reputation. I think the Kusari government will find that everything listed above can be clarified and cleared. If this is some kind of inside conspiracy attempt by corrupt Samura officials to cease my clients trade with the Gas Miners Guild, you will be looking at a major galactic incident on your hands. We await your response.

Upon further review, the Kusari State Police sees no need for a formal court date to be scheduled for this incident.
Your client was piloting a ship that was clearly marked on the KNF's sensors as a part of a known drug cartel. This is a clear and incontrovertible fact. However, due to the many discrepancies between evidence, submitted both by you and the Naval Forces, the Kusari State Police cannot attempt to prove Shibaya-san's guilt beyond a shadow of a doubt.
Therefore, the State Police are [color=#FFCC00]releasing Toji Shibaya from their custody immediately, and are returning his vessel to him. Your client is cleared of all charges.
It's possible that either Shibaya-san's transponder or the Naval Forces pilots' sensors were malfunctioning on the date of the encounter. Please ask your client to get his ship's transmitters inspected as soon as possible.
