Most factions are very protective of their guard systems. Don't complain if you are met with excessive force - And be aware that transports may be shot at by capital vessels of the faction owning the guards system in those places. It's usually considered polite to ask the owning faction for clearance before entering.

As far as I know, no. Consequences are in-character only - Other players most likely will chase you out or fill you with plasma if they catch you. Assuming you have atleast a vague reason for being there and doing what you are there's no rule to prevent you that I know of. By a "vague reason" I just mean you shouldn't really be seeing, say, a Liberty Navy tagged ship flying through an Outcast Guard system looting wrecks and exploring. The only thing I'd take note of is not to mount any faction-tech that you might find upon said wrecks.
On my first days here I also had people dictating "rules" to me that didn't exist, although mine was the more generic "You can't pirate me, read your ID, it's against the rules!". I could, but did as you've done and held off and asked instead to be sure. Turns out he was "role-playing" that statement when I later asked him to explain.

Someone told me this once.
As other people have said, it's not against server rules. At the same time, you need to always keep rule 6.10 in mind. If you're pulling a raid where you're going to head in with 3 or 4 ships, then it's considered in good taste to let the owning faction know you're coming. And if you're not - just remember that there can be in-game RP consequences for your actions.
For example, people that trespass in Omega 56 tend to find themselves with large bounties on them, valid anywhere and everywhere, until they pay the fine assessed for trespassing. Last person that happened to decided that after he'd been blown up three times in his transport by our bombers that he'd pay the fine.
