Ptrans Pirating infront of a Lawful BS

Here it is. Was in my Battleship with a transport near by. A Pirate transport pops up, and demands cargo from the transport right infront of me. I tell him to leave. He says to transport and i quote: "ahh,the big toy isn't going to shot me" then starts shooting the trader.
Now what you all think. OORP? Metagaming? Abusing the rule caps cannot shoot transports? Discuss.

I think the rule should go. There must be a way how to balance it without rulelancing.

Not my point. I have a Fighter/bomber/GB/Cruiser. I just think it is just OORP to pirate infront of a cap, just because rules claim the cap cannot shoot you. I am in no way asking that caps be allowed to shoot transports, I just find this OORP crap to be power gaming.

Let's reverse the situation for a moment. Couldn't a Battleship idling in Liberty Core space be considered OORP?

Edit: Consider that there are already Battleships assigned to protect each house core system... the static ones.

And how do you want to force a pirate transport to stand down if you are in no way asking that caps are allowed to shoot transports?
