What you're describing here is powerplay/metagaming. People use it to do what they want and effect other people, wether they want to or not. Like you sitting a bar and getting second hand smoke and subsequently cancer.
Personally, I have no problem if someone justifies the char's actions in-RP. E.g., if someone with <insert ID that can't ally with nomads (almost any)> RPs that his char is allied to the nomads (if that is really RPed of course, not just "Dun touch the nommie, or I kill you"), I don't mind him engaging me at some point (yeah, I'm speaking about that case with my =LSF=). In theory, two rules collide ("all attacks must be results of some role-play" vs. "ID rules come first"), but I'd stick to the first rule (however, others may or may not have the same attitude). Actually, I doubt I'd bother filing a report anyway (even if the RP was like "Dun touch the nommie, or I kill you", I'd simply defend myself). In role-play vs rule-play I choose the first (unless something is clearly against the rules: e.g., cruisers/battleships vs transportsners/freigthers).
Also, remember the short TCG-Order war. Nobody was sanctioned, if I'm correct. It depends on the players and their preferences. If someone is willing to find an in-RP way out of the situation, then there will be no sanctions.

LaBrise-LE hostilities are the result of agreement made by LaBrise and IDF (that is completely in-RP: you do your job, we do our raids). This is more than simple RP, it's already faction diplomacy. Note: this may or may not be +LE+ leadership's position, that's just my own attitude. However, I doubt that they have problems with it as well.

I have to agree with Dancing Lady, so as those who say that rules should affect all without exception. Is that a contradiction? Than I have to expand.
If you have a roleplay reason to break a rule, make sure that the other party (parties) aware of that and accept it. If you have the slightest doubt, it's the best to ask for an OOC confirmation in pm. And get a screenshot of it, just to be sure.
It happened to me before that a cruiser was shooting my transport. It was a conclusion of a chatter when we both formed a picture of the other's crew, and it was obvious that the situation will lead to a fight - even before in two brief lines me and the other player agreed on that that's all right.
But what's the situation with an Outcast battleship in Liberty spotted by the rogues? Everyone knows they shoot those down if they come that far. As far as I know even the OC leaders accept that if a captain of theirs makes a mistake so crucial. Would you report the rogues? Would they get sanctioned if someone did?

I remember when I was forced to shot other Morph on my Morph by Phantoms. And when I in PM told him I can't do that (because of Mprph ID rules), he told me "RP over rules."
