well the intial question was "Do we have an ID that allows for..." to which the answer is "yes, the maquis ID" (based on the tiny bit of information we have, which is an IDF tagged ship).

1. Depending on the ZOI the faction has, it may or may not be against the rules to be there in such ship. I'm not aware of any rules regarding cloaks, so pirates can use cloaks in house space. However, it is against House Laws, which are to be enforced by the proper police or naval authorities, but are not against server rules.
2. Flying a Libertonian ship is against Rheinland laws, so the player may get shot. As a proper Rheinland authority, you have the right to destroy the transport, if you don't, up to you, but normal people would shoot it as it's part of roleplay. If the transport wants to avoid this situation, simply, trade somewhere else, or with a different character. Trading through embargos is always risky.
