Well, Tel-Aviv clearly built his base where he shouldn't have.
On the other hand I believe that's in KNF interest to keep the base for both RP and OORP reasons. A supplied lawful base will bring shooting fodder in form of unlawfuls, destroying a fully operational Kishiro base is a bit too draconian even for the KNF.
I understand that KNF wants to protect the integrity of Kusari Legal Codex though destroying a base will just piss the Kishiro guys off and they will most likely move their activities elsewhere.
Let's pretend the base was built according to Legal Codex and drifted due to <insert science here> closer to the station but remains stable. Nobody's at fault then and exception can be made due to unforeseeable circumstances (science/nature).

See RP wise this makes perfect sense to me, and would be a great solution. BUT! No way will KNF take this route, as they have to wave around power, and say "you broke law, we smash you now" because they can.
They use RP for not shooting the Itabushi(or whatever it called) because they cannot remove it even if they tried. They just do not have the power/resourses/ships/players whatever. So instead they will pick on the new base to act like they still have power in Kusari. When in truth we all know they do not.
They probably cannot remove the new base if it is properly stocked, as in off hours Kusari is empty, and 1 5K can fully supply it in this time to withstand the next days assault.
Bases are just to powerful, and to hard to kill. Anything less then 20 BSs constantly slamming it, and nothing.

What ooRP favoritism exactly? Do you even realize the fact that KNF asked to take out Itabashi station and was told not to by the Government?
It's not one base breaking the law while anther doesn't - it's one base gaining an exemption for the inRP support of [l] while anther getting destroyed (and not even by [KNF], it was [KSP] taking it out).

And sure, they can go and start a mini-war of sorts with KNF, which will just get them FR5'ed to nearly the whole house - and what gain they make by that, hmmm? We made an offer to cover for OUR mistake by approving it without checking the exact location first, yes we made one and we acknowledged it - so we paid the costs of building said base. Since the mistake is only partially ours (they should've looked into the Codex), we don't feel obliged ooRPly to start and help with the building of a new one, should some of us help? Maybe, but not out of the need to cover up for a mistake but since mere wish to help.
