It could be done after a single report and without contacting the suspect to hear his side of the story. And discussing after the fact can rarely change anything.
Well every now and then they're packs of members who like to be a collective bumqwat and troll everyone till they get banned. Then people QQ because they think their trolling is funny, and the bans are unjust.

And at least if it is 'weaponized', the accused has much more ground to stand on this time as it's a two step process. If people still hound after the accused after the admins have spoken to them, I imagine the staff would notice something is up.
Rules are already being used as shield and sword. Problem will remain as long as staff keeps processing reports made out of grief rather than concern for healthy community.
