Yes and no.
You can 'pirate' smugglers that are carrying contraband. And you could always RP with the pirate that you might consider taking a donation to look the other way while he leaves the area instead of trying to collect the bounty on him. But as for general pirating of unlawfuls, not really.

Right, there's technicalities in there such as the pirate in a certain area of space being worthless to the hunter (EG: Corsairs in Rheinland) and therefore not a valid target for destruction, so they're not valid for extortion either.
But yes, you can extort a pirate or a smuggler caught red-handed in an area where they're considered a valid target. Though that usually just serves to make them angry and start the shooting.
