Falcata is Border Worlds Bomber, not an Outcast one (Although it's an Outcasts Design) so it goes under "Border Worlds Vessels" column in Tech Chart, which means, Pirates can freely use it. (Same goes for Sabre)

Havok Mk II is Ageira/Civilian, more like a Lawful Civilian ... haven't seen any pirates using that ship.
Afterall, its only sold on bases hostile to any unlawful faction or group.
