No. You can hit the cloak button the very moment you're undocking, though. Snubs can cloak away like that very easily, smugglers however need 20 seconds to cloak away. Enough time to CD them and fine/destroy them.

This would mean, that If I encounter any Smuggler in my Outcast or Sair ship, all I have to say is "Attacking Target X." and not have to wait for a response. Traders with the cargo are combat targets and no demand needs to be made, right?
Another question, what is the difference between the two contraband cards? They look the same to me. How are Corsair/Outcast forces supposed to differentiate between two contraband cards? Are they merely supposed to look at whether the ship is enter or leaving the system to determine whether it is a friend or foe?

Standard engagement rules. You can the ship and make sure it is the right commodity - as Corsair you can only attack the Outcast Commodity smugglers and vice versa. You can't attack people carrying the stuff from Crete to Malta, but from Malta to Crete. The commodity has the same name but it's two different commodities with different descriptions.
When it's a valid target, you give the two standard engagement lines at least and then go for the kill. No mercy with smugglers, you won't get much RP from them.
