Well, don't you think that as a smuggler/unlawful trader you shouldn't fly past the station and planet areas that contain such patrols, as well as through trade lanes, or at least have enough wits to avoid their attention if you do so?

Lawfuls should do that, and there's already sufficient defences through turrets to prevent loitering.
We also should encourage unlawfuls to stick relatively near to lawful escorts so police players have a chance of catching them.

Because they slow you down. You're not supposed to roam around in the nomad systems without threat. Those things provide a threat. They provide more time for the nomad playerbase to react. They also, in some areas, slow down ships and allow hard NPC patrols to take on them.
