Then, if they do not stop, I repeat. If they still do not stop nor even talk, I go with
Very well. Opening fire on uncooperating vessel and I start blasting away ( I even have preset engagement message that I use as well)

How can I make someone stop when I try to halt him and he is running away? I mean, its hard to type in pursuit between stones, can I just use engagement notice and fire on his ship? Or if he does not say a word after 3-4 my lines of RP, can I fire?

Just as a suggestion, change your preset to:
Halt your ship #t, cut all your engines or be fired upon!
The reason I say this is that using the #t in a preset means it's going to use the name of your current target (which should be that trader). That resolves any doubt as to who - or what - you're going to be shooting when he doesn't stop.

Okay so if you have enemies, known enemies. You have engaged them several times before. You are known to be hostile with this person, not just by reputation NPC wise or whatever but you have actually fought them. Can you go up and shoot them down?

No.
Not without roleplaying with them first.
In short ; Do NOT fire any shots against any player controlled ship, without roleplayng first. The exception is a CD, since that is not considered an attack.
The only exception to a CD being considered not an attack, is if it is fired by a low-lvl (less or equal to lvl 29) against a cruising higher lvl player (rule 5.3.b).

Yes but even if it is then fired by someone who is above level 29 it is still not considered an attack because it's merely a CD as stated in rule 5.2.
Look, you people are starting to turn into religious fanatics. You're quoting rules like people quote scripture. I don't think I've ever been a part of a server where people hinged more on the rules and how to get people in trouble than actually playing the damn game. What a killjoy. And just like the bible itself, half of the crap is contradicting itself. Go figure?
I've played on some places where there is only a rule debate -once- in a blue moon over something that really was disadvanaging or possibly overlooked completely once someone took the time to review it with a fresh perspective. Here I have noticed people are always complaining about the rules, trying to get them changed, simply don't understand them because it's as confusing as the damn tax code in the USA, or they spend their time in game quoting the rule book at people in system or private more than they actually role play.
Now you could go and say that ,''Discovery is such a large community because of the good rules that we have'', or possibly it could be that a majority of people make a career out of being rule-lawyers vs actually getting things done in role play.
I speculate that out of a community of 14,680 members on this forum that half do not have an account on the 200 slot Discovery server and out of the half the possibly have an account rarely play. So if you figure 7,000 people roughly 3,500 of those people might have an account then why aren't there more factions played on this server? Looking at the numbers I'm a little dazed about why there isn't some small indy faction for every npc. I wonder why Bretonia is so dead most of the time and why all of these official factions are so extinct yet still hold their place. I've seen several of these official factions merely have 5- members that come on once in a blue moon and I'm quite a bit at very different times during the day and night around the clock.
And yeah I'm sure those forum members do other things here like posting on the forums vs playing the game itself. I'm also a little sure that a few of those accounts are inactive, space saver? (by the way my old account stood for more than a year now and I haven't logged into it once I don't believe.)
Now I'm not saying this is all based on a deficiency of the rules, I'm personally ranting about that on it's own merit that there could be too many and with less stipulations to them and less rules in general there might be a bit more happening on the server. I stroll around and see people with nothing left to role play about save for isn't ''asteroid A'' pretty or squabbles about this and that is illegal.

I suppose that this would not be the appropriate time to mention that I'm a licensed tax professional in the USA, or that I used to manage a tax office. :P
Seriously - MORE happening on the server? During most of the times where Europe and the US are awake, there are normally 120 - 180 players on at a time. And even in the middle of the night (for me), there are still always 60 or more players online at a time. I think this is when you need to get into your understanding of role-play - which is basically acting. You are acting the part of a player on the stage that is Discovery. And it would be quite nice if we could have room for 400 or more actors online at once - but we don't, so we deal with what we have.
In any event, this topic was about a line by line dissection of rule 5.2. I'm going to leave this open through the rest of tonight, and then this week I will edit things and pin this, so that there are examples that are clear and understandable to everyone.
