In the event that there is an ongoing battle and someone shows up - there is no such thing as an innocent bystander. You sit and watch a battle, you're a potential target.
Now, I do realize that the rest of us don't have the full information from the screenshots, but I think a slightly fuller explanation here would be in order. (I'm not trying to be obnoxious here - it's just that it's previously been determined that, for example, passing bots or bats from a transport means that they're taking part and thus fair game. Or that if an underlevel is sitting next to a battle, within a couple of klicks, and gets vaporized, that it's his own darned fault.)
What specifically were the circumstances whereby this particular cap ship took out this particular transport or freighter, so that we understand? Thanks!

And as much as I hate to agree with Agmen, and anything that promotes PvP like this, it was my understanding that if you stuck around in a battle area, you were fair game. You don't want to be shot you move along.
Aka: Loitering. If you are just passing through.. Oh a fight, leave.. that's fine.. but if you stick around, eventually you're going to catch some flak, and I wouldn't blame them in that case.
EDIT: only exception might be a camera ship (maybe they are video'ing the fight). but if they get blasted, ooops, it's a battlefield afterall.
Enjoying a game isn't always taking the easy route, sometimes you have to take chances and trust in luck, sometimes that luck takes a big bite out of your backside.
I don't get how people can be blasted accidentally. You have to be actively pursuing a target for them to go down. Exceptions to this would be a battleship since a stray volley can do a lot of damage to an unshielded target.
But really if you get struck down why being where you shouldn't that is your own darn fault. Same goes for those who feed bat/nanos you're just as much a risk as the targets themselves. By prolonging their life. Or aiding distractions.

Those situations allow a ship to be engaged, the attackers still have to follow the cap ship engagment rules. If a transport is passing to people in a fight, you can attack him, but not with a cruiser or battleship unless it fall under these exceptions.
6.7 Attacking transports, liners or demanding cargo from the same is not allowed for cruisers and battleships.

It has never been allowed for Cruisers or Battleships to attack transports, even if they are passing bots or observing the battle.
Because when you say there is a situation where Cap pilots can shoot at transports, in their heads they here, this is a situation where they must shoot transports. And then the guy undocks from Manhattan in the middle of a LR cruiser attack on the LN, and he tries to figure out what is going on, and then of course he has been there for a few seconds so the LR cruisers blow him up.
