Haven't been able to replicate this. I've sat outside the planet for 15mins or so, and refreshed the system multiple times to force NPCs to respawn. NPCs in Freelancer are kinda dumb at times, especially when we give them very heavy transports they weren't really designed to understand. If they come at a planet at a steep angle, they will try to turn away but may still hit the atmosphere regardless.
What usually happens is that NPCs will spawn relative to the player upon undocking from the planet or exiting a TL (or Jump Gate). It's the same deal with NPCs spawning in the middle of minefields like Zone 21 or the New Berlin Gate in Dresden.
In New Paris's case, what is likely happening is that the Mooring Fixture is treated as a "base" and the convoy is being spawned in a radius around the Mooring Fixture... including within the planet's deathzone.
It happens as NPC spawn in area of a player, and sometimes want to dock or change course and sometines they had a navmap reporting their patrol is hittibg the planet, but it is a known FL issue actually
