Jesus Lyth... I've read some dumb stuff in my time, but you really do repeatedly get the wrong end of the stick with this pirate cap issue.
It is worth pointing out that the game is harder for those who have to defend regions of space.

Sath explains my point. You need to see things from the shoes of other players: I am sure I am not alone when I say that it is extremely frustrating to try and pirate and every time you're simply met with about 90000 LNS caps coming for your ass, most likely they will find you and gank kill you, leaving you upset. I'm not saying that Law Enforcement doing their job and hunting down pirates is a bad thing, but they're part of the problem as to why pirates aren't being pirates.
It sort of works like this:
Pirates pirate Traders
Disgruntled traders get angry at the pirates and make lawful caps to crush the pirates as much as they can
Pirates get sick of this and start prioritising killing Lawfuls over actual piracy
Rather than being a wonderful cycle, minus the pirates hunting lawfuls, we're stuck in limbo between the last two points. A player making a pirate to do piracy is being rarer and rarer: they're more or less gearing themselves up to desperately tank lawfuls as much as they can.
The thing is, people don't want to pirate [in Liberty] anymore. It's just really not entirely worthwhile. I'm sure there are players out there who are dedicated to still committing piracy within Liberty and for that I give you kudos, however the majority of unlawful players are members of the anti-lawful pirate militia. To be honest, we could probably just call them the Hellfire Legion 2.0, as that's basically what they are.
As for solving this? Who knows. The problem isn't really a mod related one, but a psychological one. I am for blocking Outcast caps out of Liberty though, but mainly for giving life to other Liberty unlawfuls and because Outcast dreads in Liberty are a bit ridiculous.
