It may be just my impression, but for a space shooter, there is little combat in Disco. So... ofc it would be nice if everybody thought about "Ohhh... I might die!", but the reality is: pews = fun. The game would be really bad without it. So - on a gameplay basis - it's not bad if many jump into combat and few retreat because 'I could die!' considerations.

This would hit newcomers hard. I have like... 200 ships in all regions of Disco I can log to. Kill one... k. Kill the one ship a newcomer has... and you banned him from playing. And we all know that new guys died fast, a lot, without a chance. So, no. I understand where the wish comes from, though.
The solution is inside you, however: after victorious combat, move out. You won. If you want to be nice, even log off for a moment, so that the other guy is "alive" again and can continue playing as he wants. By you moving on, you guarantee that you do not bump into the "dead" guy again soon. If I do, I greenmessage him friendly, tell him how I see the situation and avoid interaction. If he pushes for it, sanction for reengaging and move on.
