Then I noticed that one ship followed close (the bomber), while the other would catch up using formation, EK, fire a CD, repeat.

If this is happening in cruise, then yes, it is a legit tactic.
I'v been chased by people forming up on NPC's to catch up on me, and then fire a CD from ekill.
It's not an exploit, simply because it is teamwork.
Maybe the bomber didn't have CD's, so there was no point for him to drop from cruise?
Anyway, I see it as totally legitimate.

Sorry for getting it wrong, I'm just used to 'cruise catchup' threads.
