You can only tractor in as much as your cargo hold (IE if you have a 1000 cargo ship, your tractorbeam will stop when you're full)

Yes indeed however once in a while it will glitch, i've had it happen to me once on single player. A titan with couple thousands k is a nice payback before the next mission.:) For the server, jettison the extra right away before going anywhere.
