Lawfuls are selective in what transports they can engage. It's a pretty small demographic from the overall representation, derived from individuals who intentionally chose to perform action X.
Unlawfuls can go after anyone who hops into a transport.
Transports aren't balanced to deal with cruisers.
Maybe that'll change in the near future.
But, as it stands, cruisers would be absurdly op pirating vessels. It would end up being a game breaker in this fellow's humble opinion.
Transports also aren't balanced to deal with 2 Barghests. If you get caught, usually your options boil down to "pay up" or "die". Honestly, if I was the transport, I'd rather stare down a Scylla than a pair of Barghests. Possibly even one Barghest. The Scylla is easier to see from a distance, too.
I'm not convinced this will change a transport's chances at all. If the cap could butcher them, chances are the pilot could butcher them with another ship that's already allowed to attack transports.
I doubt that official Factions will start spamming capital Ships to use them for Piracy. It'll even mess them up pretty bad. Not only that the Reputation of a Faction can change, it'll surely have some ingame Effects if a capital Ship is being spammed by the Faction.
That a Transport isn't balanced to a Siege Cruiser or Kusari Destroyer didn't really help the Pirate Transport as well.

I think if an unlawful Faction is in a House like Liberty Rogues, Blood Dragons, Mollies and Red Hessians they should only have that Right in that House, though I am not sure if Red Hessians should be allowed to do that in the Omegas too.
For Corsairs I think the Omicrons, Sigmas and Omegas should be a Zoi, if not even Omegas and Omicrons only.
For Outcast I'm thinking of Omicrons (,Sigmas) and Taus.

Yes it would.
But I do believe that the ability to use caps for piracy does not mean that an official-faction cap will be spotted everywhere.
Sure, it gives you an advantage over the poor trader, but would you like to get called power-pirat in the end?
Because that would be those persons taking caps to extort money from traders.
Besides, taking them down in a Gunboat/Bomber/Fighter leaves them with more time to decide. And is much more fun.
There shall be traders that decide that they will pay after you started to shoot them.
Dessie/Cruiser = Pulse, LM, done.
And i do trust that those people who then have this ability, will know how to use it.
And if not, the faction leader can do something about this problem.

Pennsylvania is well within reach of the Liberty Navy, but they don't have this faction right there. Corsairs being able to wield caps against transports in Alpha or Omicron-80 is a bit of a stretch. Ranseurs blowing up Xeno armored transports in Tau-45 is also a bit fishy.
The range at which this faction right applies is a small subset of a faction's ZoI- where their power is greatest, and their authority and dominance militarily uncontested. No one doubts the Liberty Navy's ability to get a fleet to any point in Texas in minutes. For smaller factions, the definition should be a bit different, as they don't really "control" space, but it should still be "where a faction is most powerful" rather than the fringes of their territory. Omega-41 and Omicron-Theta are well within the dominance of the Corsairs, but they are far more thinly spread by the time you get to Omega-49.
Hopefully my point is clear, as I need to run off to class now.
I'm up for a trial period just to see how it goes, it caused less friction then I expected when lawful caps were given this trial. Every faction ID (I could be wrong here) has access to ships that can counter Cruisers; Bombers. Give it a shot, I want to see how it goes. (Also have a Kagutsuchi I am not sure what to do with...)

I agree with that statement. Last time, when caps could pirate, it just got silly, especially around the JG from Sigma 13 to Honshu.
If it's going to happen, I'd make sure the ZoI is VERY limited like one JH from the home system. To be honest though, I'd rather not see it all.
Thats just my opinion based on whats happened in the past. I believe the only change thats made Cap ships able to kill transports is specifically, the pirate transport commiting piracy right infront of the naval ship and the pirate laughing at the capital vessel.
Poor roleplay but there you go. People exploit the rules.
The same will happen with pirates in capital class vessels..again.
