We already have one device which acts like a free pass to get away: The individual jumpdrive for battleships.

Oh, the QQ and tears-generating move, if that really matters to you that much, just counter those with your own: shieldrunning, basehugging, JD3 BS, botfeeding, ganks, caps. The unfortunate fact is that players still have complete arsenal of jerk moves at their disposal.
In short, this is player issues, not cloak mechanic.

Perfect game mechanics is when there's no need for rules and jerk moves. You can't simply break rule or be an asshole.

Hey... just counter the cloak with your own cloak.
When we are finally all cloaked, no one sees anybody any more, fights always end without an explosion and a winner and the few that still play the way it was meant to be played get jerk-moved into oblivion - then we will have a game worth playing.

Well, great for "PVP-whores", they can fight again!

Aehm, does a cloak kind of increase your fighting skills? I really should get one then! If your target has none and you do, hm, the opponent dies and ...
