Somali pirates out in the ocean aren't going to give your tanker ship a chance of roleplay to get out of the pirating interaction, such is life in Discovery. If you get caught out at a jump gate or popped out of a trade lane, you are dead in the water and at the graces of the pirate. Some are better at roleplaying than others.
You as the player gets some choice in who you roleplay with. If you see a toxic pirate in the next system over that likes to shadow log and pirate in front of battleships, you can land and log in to a different ship. Then watch as they complain that there is nobody to interact with Same goes for gankers. The worst players here watch the player list like a hawk, you have to also to avoid the toxics.
I hope that either all of us or none of us are judged by the actions of our weakest moments. But rather, by the strength we show when, and if, we're ever given a second chance.
Some good points raised here, and I would also add that there are a number of people who play on Disco where they very much struggle with the English language and genuinely do not know what the RP part of the server entails, through no fault of their own.
With regards to being caught in the wrong ship in the wrong sector, I would point you towards the House Roleplay Laws. If you're in breach of the law, you are fair game and ignorance is not an excuse in the eyes of the law (for most police forces/navies anyway). That being said, I have seen some people escort people flying an illegal ship to a nearby base and ordering them to change it. But bear in mind, if you're flying a freelancer Defender for example in Liberty space, that possibly amounts to theft of government technology and we the LN do not know who you could have been sharing that technology with, be it insurgents, rogues, outcasts, etc. therefore destruction of said technology is 100% warranted inRP. Freelancers are an unknown quantity in any given situation for lawfuls, and are rightfully treated as such.
Now, if you want to earn the right to fly an illegal ship in government space, every government has a license requisition centre where you can request permission to fly an illegal ship. If John Navy comes to bother you about it, point them to said registry and you are doing nothing illegal. Here is Liberty's, Bretonia's, Kusari's, Rheinland's, and Gallia's. If it isn't specifically a ship you need to request a license for, you can look around on the government subforums for the relevant post.
As for shooting on sight, prisons do exist, yes, but we the players have no way to enforce a law by godmodding someone's character and stating that they cannot play the ship they worked before because they're in prison. There is no functionality for it in-game, and even if there were, that's paramount to giving people the ability to lock people out of their characters at will by sending them to prison, and I for one can see a lot of ways for that to be misused to say the least. Shooting people is the only way people really have to reliably and (somewhat) meaningfully enforce the law.
Finally, I will touch on your points about player agency. Yes, you have a right to roleplay your character as you see fit. Other people also have a right to see your character through their own character's biases (And yes, some players unfortunately also muddle that with oorp bias). It is wholly unrealistic to expect a character to have sudden and intimate knowledge of every facet of everyone they come across. If my Navy character comes across people breaking Liberty law, she sees them by and large as lawbreakers. God forbid you come across LSF when breaking Liberty law because they're likely to be even less forgiving.
Pretty sure I recall seeing quite a few topic threads like these pop up back then as well before leaving. These kinds of events will always result in someone eventually bringing it back up again. It's like a terribly vicious, repeating cycle.

Players, new but also old, need to be given better advice than the "be excellent to each other" and 5-page "this is how you role play correctly, noob" tutorials, which consist mostly of virtue-signaling that doesn't really help anyone.
Part of the problem is that if you give people advice that is actually useful for avoiding frustration on both sides, you'll get pounced on by the most pious of the pious super-RPers, many of which are complaining about /l1 /l2-ers while heroically /l1 /l2 /l3-ing those who they deem unworthy off the server, or at the very least, out of "their" space, because they don't adhere to the highest of their personal standards.

No, of course not, you always have a chance to come out ahead via combat. That's what makes Discovery so fun.
RP is not improv and claiming that it is makes no sense. RP is a game. Sometimes you RP with friendlies and you can bounce off and talk as long as you like or as long as you are interrupted.
But a situation where enemy factions who are rephacked to -.9 to each other and are mortal enemies in lore spend 30 minutes of needless and senseless verbal back and forth and become best friends by the end makes no sense either. Mortal enemies means when you see each other you RP with guns.
PvP is also a valid form of RP. Claiming that there is an unrepairable rift between the two is delusional.
You are allowed to try to talk your way out of a situation, but if you are up against a hostile, he is allowed to shoot you.

Somali Pirates do this to survive......they will not sink a ship for fun.....they will not murder those who are not resisting for they fear beeing shot as well.....and they would NEVER raid a vessel without cargo....
My point is...even pirates have a brain.....and if its possible to reclaim their ship in one piece....why destroying it just for the giggles....

If your using something that is illegal in house space and you refuse to cooperate with the police/navy you will come under fire.
Some people on this server only log to kill make a note of the name and just log out if you see them in a system you are heading towards, not in space though as that is against server rules and you can be reported for it.
If you are getting pirated and don't respond or cooperate expect them to attack you.

What about a Zoner and a corsair? thats true neutral....
Many Freeports are frequently used by Corsair to trade goods...
Thats why my character since childhood got interested in corsairs in the first place.
Its a realistic background for my role and the people I RPéd with usally gave a FXXX about my origin.
Just doing THEIR thing...leaving my context out of the picture...
