Because in reality, it would normally take a battleship days or weeks to be repaired. Attacking a bunch of pirates, who can't use a ship larger than a Gunboat mind you, with a battleship, then docking when you get hurt only to repair in 15 seconds and engage them again.. Pretty much ruins everyone else's gameplay.
There was a time when Discovery didn't even have a kill or fleeing rule. If you died you could respawn and get right back into the fight..
One example; 3 AW vs 7 SF/TC (This was ~3 years ago). Back then, if you died you could respawn and come right back.. Well, SF/TC attack AW at FP10. Ignoring the fact that Bretonian Armed Forces ships were docking on a Zoner Freeport in Tau-37 (RP was lax then, must strictor now), the fight between 10 people lasted 3 hours. Why? Because everyone who died just came right back to the fight thirty seconds later from the Freeport.
Combat doesn't end until one side's players basically give up or get bored and leave. Unlike EVE, when your ship gets blown up here, it isn't gone for good. EVE can allow players to dock and repair and come right back.. Because if they DO get killed that ship is gone for good. A lot different on this game. Don't try to use EVE as an example of things to do here, it doesn't work. I know, I played EVE. The two games, though both space sims, are vastly different from one another.
This is why the 'when you are killed, you can't attack the person who killed you or reenter the system for four hours'. Because if that rule didn't exist, a battle would never end.
On the main topic; Yes, there are lawfuls. Plenty of lawfuls. Liberty had a fair amount on last night as I was sitting around at Bethlehem for two hours. Bretonia had about ten people come on to fight off a Corsair invasion. In Bretonia the lawfuls outnumber the unlawfuls. Kusari is about even. Rheinland is kind of dead right now, but usually it's about equal, maybe a few more pirates than lawfuls. Liberty is just a bad house, and Liberty is what most people try to base server population on.. Just because there are more pirates than lawfuls in Liberty does not mean that is true in the other three houses.

To be clear, I'm not arguing the 4 hour penalty for dying. I 100% agree with that... the point I'm trying to argue is that a fighter COULD rearm in about 30 minutes (RL aircraft carriers, fighters sometimes land, rearm, and head back out). Believe me, I agree that gunboats+ couldn't possibly do it that fast.
Let me rephrase what I'm trying to say, maybe clearer this time: It seems like fighters and bombers would be able to disengage from a fight, and IF they successfully flee and survive (If they die in the attempt, it's still a death), they would be able to re-engage later, possibly if they go regroup with reinforcements.
It just seems... off. From my point of view, that makes perfect RP sense, and it seems un-RP'ish that this very specific but common scenario is not allowed.
I'm probably beating against a brick wall here, but I've learned to at least bring up questions rather than just let them stew and ferment. It's just that so far all of the responses of why we can't do this don't actually address the point I'm trying to make, but rather similar-but-not-the-same points. (capitals doing this is n/a, shield running is n/a due to still having, say, a 30 minute restriction to name two)
Maybe the head of the LN can answer this?
Oh, and I'm very well aware that this isn't EVE - why do you think I'm here? (though I play both actively) Don't worry, I'm not trying to say "this is EVE" or "this should be EVE" I'm not, don't worry.

Allright, if you insist on looking at it from an entirely RP point of view, can you really repair your flaming badly damaged hull, replace all your dead crew and get back in the fight with 100% efficiency?
System is fine as it is, good balance I'd say between RP and what works.

I still don't get it how you can be pirated so much and loose so much?
In the last 4 days me and my room-mate made more than 450 mill mining and transporting ore(I am not power miner or something I am just sick and I stay at house because of my illness).
The miner paid around 6-7 mill taxes to pirates(randomly around 300k per pirate ones wanted more so around 500k or 1 mill)
On the way to Narita I wasn't robbed at all.Only 500 pieces of ore that I gave to a one nice Hogosha that role-played nice.It is true that the Hogosha gangs you with 3 or 4 transports and want to take all of your ore but you can simply go around them.It is true that the pirates are really a spam but if you have your GB escort and nice transport ship with many guns you can just run or blast them.If you cannot play in a team mining is not your way of making money. Just try to trade in not so populated space.
In that time the pirates tried to rob me at least 10 times
I was only once blown by 2 pirate bombers 2 GBs and 1 VHF near the Colorado jump hole.
Try to use escorts - heavy ones- GB with enough armour and bomber.
Try to reckon the route. Find some friends to play with.

No need for more so sad factions, lawful ones that is in Liberty. Just stay independent and listen to what real faction members say, especially Liberty navy.
